GEORGE TOWN: A High Court here Friday reduced the fine imposed on Padang Serai MP N. Gobalakrishnan to RM1,000, from the RM3,000 imposed by a magistrate’s court for obstructing a police officer.
Judge Datuk Zamani Abdul Wahab also ordered that Gobalakrishnan, who had paid the RM3,000 fine in full last year, be repaid RM2,000.
Gobalakrishnan, 51, was found guilty on May 14 last year of voluntarily obstructing then Chief Insp V. Saravanan in Jalan Utama here, at 12.20am on Jan 29, 2002.
Magistrate Ainul Bashirah Dona Don Biyajid had fined him RM3,000 in default six months’ jail.
After the sentencing, Gobalakrishnan’s application for a stay of execution was dismissed and he paid the fine.
He then filed a notice of appeal to the High Court against the conviction and sentence.
The offence under Section 186 of the Penal Code carries a jail term of up to two years or a maximum fine of RM10,000, or both, upon conviction.
The sentence by the lower court had raised questions about Gobalakrishnan’s status as MP.
However, Election Commission chairman Tan Sri Abdul Aziz Yusof said he would remain the elected representative of the constituency.
